Elenita Binay’s case regarding overpriced hospital beds, equipments continues

Vice President Jejomar Binay’s wife Elenita Binay who was charged with malversation and graft over the alleged overpriced 102 hospital beds, 202 bedside cabinets, 10 ICU beds, 4 orthopedic beds, 5 sterilizers worth Php 45.2 million which did not went on public bidding when she was the Mayor of Makati will be tried by the Sandiganbayan Third Division.

Dr. Binay earlier filed a motion for reconsideration however, the anti-graft court upheld its earlier decision that there is a probable cause and the case should pursue.

“After personally reading and evaluating the above-enumerated document – the court finds the existence of probable cause that the crime of – (graft) and malversation under Article 217 of the Revised Penal Code on two counts each, have been committed and that the accused are probably guilty thereof,” said chair of the Third Division and Presiding Justice Amparo Cabotaje-Tang in a decision, with Associate Justices Samuel Martires and Alex Quiroz.

Dr. Binay who had bailed prior to the issuance of the warrant of arrest is set to be arraigned on Nov. 20 at 1:30 p.m..
